Rojelio Hernandez II was charged with aggravated battery today in Marion County.
The Marion County Attorney did not file kidnapping charges because after reviewing the investigators' report, she decided they were not warranted. That report is not public record because the victim is a minor.
Hernandez disappeared with 17-year-old Tara Simhiser in October. The pair were found two days later in northeast Kansas.
Hernandez was charged in Brown County with contributing to a child's misconduct and driving with a suspected license the day after his arrest.
He pled guilty to both counts and was sentenced to 12 months probation and a $1,118 fine.
